Terms & Conditions

1. Booking

  • All classes must be booked through the SPARK Studio app.
  • Members must have an active package or purchase a single class before booking.
  • Booking opens seven days before the class.
  • Booking closes one hour before the class starts.
  • Bookings are subject to availability and cannot be transferred to another member.

2. Cancellation

  • Members may cancel through the app at least eight hours before the class.
  • When cancelled within the permitted period, the class credit will be returned automatically.
  • Cancellations made less than eight hours before the class will be considered late cancellations.
  • Late cancellations will result in the loss of the class credit.

3. No-Shows

  • Failure to attend without cancelling will be recorded as a no-show.
  • Members using class packages will lose the relevant class credit.
  • Members with unlimited packages may have their booking access temporarily restricted following three no-shows or late cancellations within 30 days.
  • Repeated no-shows may result in further booking restrictions.

4. Waitlist

  • When a class is full, members may join the waitlist through the app.
  • Available spaces will be offered according to waitlist order.
  • Members will receive a notification when their booking is confirmed.
  • Members who can no longer attend must remove themselves from the waitlist.
  • If a member is confirmed from the waitlist within the eight-hour cancellation period, the late-cancellation penalty will apply until one hour prior to the class.

5. Arrival and Late Entry

  • Members should arrive at least 10 minutes before class.
  • First-time members should arrive at least 15 minutes early for orientation.
  • Entry may not be permitted more than five minutes after the class begins for safety reasons.
  • Late arrival resulting in refused entry will be treated as a no-show.

6. Packages and Validity

  • Single class: 30 days from purchase.
  • 7 to 11-class package: two months from activation.
  • 12 or more-class package: three months from activation.
  • Unlimited package: 30 days from activation.
  • Complimentary yoga classes must be used before the related package expires.

Packages are personal, non-transferable and cannot be shared. Unused classes will expire automatically and cannot be carried forward.

7. Refunds and Freezing

  • All purchases are final and non-refundable.
  • Packages cannot be transferred, exchanged or converted into cash.
  • Packages may only be frozen for medical reasons upon submission and approval of a valid medical report.
  • If SPARK Studio cancels a class, the credit will be returned automatically.
  • Schedule or coach changes do not qualify for refunds.

8. Class Levels

  • Members must book classes suitable for their experience and fitness level.
  • New members should begin with introductory or beginner classes.
  • Advanced classes may require the coach's approval.
  • SPARK Studio may move or refuse a booking if the selected class is unsuitable for the member's level or safety.

9. Health and Safety

  • Members must disclose any injury, pregnancy, medical condition or physical limitation before participating.
  • Participation is at the member's own risk and requires acceptance of the health declaration and liability waiver.
  • Members must follow the coach's instructions and use all equipment correctly.
  • SPARK Studio may refuse participation when necessary to protect the member or others.

10. Studio Conduct

  • Appropriate workout attire is required.
  • Grip socks are mandatory for Reformer and Microformer classes.
  • Photography and filming are not permitted without prior approval.
  • Disruptive or inappropriate behavior may result in removal from the class or suspension of booking access.

11. Schedule Changes

SPARK Studio reserves the right to change coaches, class times, room assignments or schedules when operationally necessary. Members will be notified through the app whenever possible. SPARK Studio will make reasonable efforts to notify members in advance of a scheduled coach substitution. Coach changes do not entitle members to a refund or credit, as outlined in Section 7.

12. Liability and Indemnity

  • Members participate at their own risk and release SPARK Studio, its coaches and staff from liability for injury, loss or damage, except where caused by proven gross negligence or willful misconduct on the part of SPARK Studio.
  • SPARK Studio is not liable for the loss, theft or damage of personal belongings brought onto the premises, including items left in lockers or changing rooms.
  • These Terms are governed by the laws of the State of Kuwait, and any disputes shall be subject to the exclusive jurisdiction of the competent courts of Kuwait.
  • SPARK Studio shall not be liable for any failure to provide classes or services due to circumstances beyond its reasonable control, including but not limited to government orders, natural disasters, power outages, or public health emergencies. In such cases, affected class credits will be reinstated where possible.

13. Payments and Pricing

  • Payments may be made via the methods listed on the SPARK Studio app, in Kuwaiti Dinar (KD) unless otherwise stated.
  • Packages with auto-renewal will renew automatically at the prevailing rate unless cancelled by the member at least 2 days before the renewal date through the app.
  • SPARK Studio reserves the right to amend package prices at any time. Existing members will be notified at least 3 days in advance of any price change affecting their active package; new pricing will not apply to an already-activated package until its renewal.
  • Corporate or group bookings, where applicable, are subject to separate terms agreed upon at the time of booking.

14. Minors

  • Members must be at least 16 years old to book and attend classes independently.

15. Locker and Storage

  • Lockers are provided for the duration of a member's visit only and must be vacated by the end of each session.
  • SPARK Studio is not responsible for items left in lockers beyond the session and reserves the right to remove and dispose of unclaimed items after 7 days.
  • A fee may apply for lost or damaged locker keys/access devices.

16. Guest Policy

  • Members wishing to bring a guest must arrange this in advance through reception, subject to availability and applicable guest fees.
  • Guests must complete a health declaration and liability waiver prior to participating in any class.

17. Data Privacy

  • Personal and health information collected through the health declaration and liability waiver will be used solely for the purposes of ensuring safe participation and will be stored securely in accordance with applicable data protection regulations in Kuwait.
  • Member data will not be shared with third parties except where required by law or necessary to deliver SPARK Studio services.
  • Members may opt out of marketing communications at any time through the app or by contacting SPARK Studio directly.

18. Complaints and Feedback

  • Members may submit complaints or feedback through the SPARK Studio app, at reception, or via phone
  • SPARK Studio aims to acknowledge and address all complaints within 10 business days.

19. Termination of Membership

  • SPARK Studio reserves the right to suspend or terminate a member's access in cases of repeated policy violations, non-payment, or conduct that endangers the safety or wellbeing of other members or staff.
  • Termination for cause does not entitle the member to a refund of any remaining package value.

20. Zero-Tolerance Conduct

SPARK Studio maintains a zero-tolerance policy toward harassment, verbal abuse, or threatening behavior directed at staff, coaches, or other members. Any such conduct will result in immediate removal from the premises and may lead to permanent membership termination without refund.

21. Amendments to Terms

SPARK Studio may update these Terms and Conditions from time to time. Material changes will be communicated to members through the app at least 1 day before taking effect. Continued use of SPARK Studio services after changes take effect constitutes acceptance of the updated Terms.

22. Acceptance

By purchasing a package or booking a class, the member confirms acceptance of these Terms and Conditions and any future updates published through the SPARK Studio app.
